Acceptance conditions

The purpose of this section of the website is to allow anybody to offer a property or a portfolio of properties to Kallal Estates Limited. To offer us property please ensure that Kallal Estates is under no obligation to evaluate, make you an offer for, or otherwise deal with any property whose details are submitted.

Please submit your contact details, together with details of the property or portfolio of properties you wish to offer after you have read and understood the Company Terms & Conditions below:

Introduction

  • 1.1 These terms and conditions govern access to and use of the "Offer us Property" section of the Kallal Estates ("KE"/"we"/"us") website ("Webpages").
  • 1.2 Please read these terms and conditions carefully before proceeding with "Offering us Property". By accessing or using the Webpages you agree to be legally bound by these terms and conditions and the Website Terms and Conditions as they may be modified and posted from time to time.
  • 1.3 These terms and conditions together with the Website Terms and Conditions are the exclusive terms and conditions governing access to, use, submission and consideration of information submitted through the Webpages. You shall not submit or otherwise seek to impose or assert any other terms or conditions and specifically, but without limitation, you shall not attach or include any such terms or conditions when submitting information to us through the Webpages or otherwise. All and any such terms and conditions will be neither valid nor enforceable.
  • 1.4 Without prejudice to the above, by clicking on the button marked "Accept" at the end of these terms and conditions and by using the Webpages, you accept that you have read, understood and agreed to these terms and conditions.
2 Information you provide
  • 2.1 Any information that you provide will be used by us in accordance with our Privacy Policy set out in the Website Terms and Conditions.
  • 2.2 In addition, the following also applies to all information submitted by you to us including all messages, e-mails, ideas, suggestions, concepts or other material submitted by you to us ("Content"):
    • you must own or have the right to submit the Content to us and all Content submitted by you must be accurate, complete, legal, honest, decent and truthful and comply with all applicable laws, regulations, standards or codes of practice;
    • when you submit the "Offer us Property" questionnaire, it must contain your real name, address and other requested details. You will notify us of any changes to any information submitted as soon as you are able so that our records can be updated;
    • you must ensure that all Content submitted to us does not infringe copyright, design, privacy, publicity, data protection, trade mark or any other rights of any third party, nor be obscene, abusive, threatening, libellous or defamatory of any person; and
    • we have the right to monitor Content and we reserve the right to block incoming e-mails and other Content if we believe that their content is or may be inappropriate or otherwise does not comply with the above.
  • 2.3 You have sole responsibility for the Content which you submit to us and you shall indemnify and shall keep us fully and effectively indemnified on demand from and against all actions, claims, losses, liability, proceedings, damages, costs, expenses, loss of business, loss of profits, business interruption and other pecuniary or consequential loss (including legal costs and expenses) suffered or incurred by us and arising directly or indirectly out of the submission of Content by you to us.
  • 2.4 You warrant and undertake that you will not use the Webpages for any purpose that is illegal or prohibited by these terms and conditions, including without limitation the posting or transmitting of any libellous, defamatory, inflammatory or obscene material. If you breach these terms and conditions, then your permission to use the Webpages and other aspects of this Website terminates immediately without the necessity of any notice being given to you. We retain the right to deny access to any person who fails to comply with these terms and conditions.
3 Modifications and alterations to the Webpages
  • 3.1 We reserve the right to make changes or corrections, alter, suspend or discontinue any aspect of the webpages, the content or services available through it, including your access to it. Unless explicitly stated to the contrary, any new features including new content, our provision of new services, or resources shall be subject to these terms and conditions.
  • 3.2 Please note that the webpages may contain typographical errors or other inaccuracies.
4 Kallal Estates’ obligations
  • 4.1 We will send you a confirmatory email to acknowledge receipt of the information you submit and to confirm the details submitted. You must contact us immediately if any of the information in that email is incomplete or inaccurate.
  • 4.2 We are not obliged, as a result of you submitting information, to evaluate, make you an offer for or otherwise deal in or with the property whose details you submit. All and any subsequent correspondence relating to such property is to be 'Subject to Contract'.
5 Limitation of LiabilityTo the fullest extent permitted by applicable law, we accept no liability for any loss or damage of any nature whatsoever and howsoever arising out of or in connection with the viewing, use or performance of the Webpages or the contents of such pages whether due to inaccuracy, error, omission or any other cause and whether on the part of us or our servants, agents or any other person or entity. 6 General
  • 6.1 We may assign or subcontract any or all of our rights and obligations under these terms and conditions.
  • 6.2 We may alter these terms and conditions from time to time and post the new version on the Website, following which all use of the Webpages will be governed by that version.
  • 6.3 If any provision or term of these terms and conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from and shall be deemed to be deleted from the remaining terms and conditions.
  • 6.4 Any failure or delay by us in enforcing an obligation or exercising a right, under these terms and conditions, does not amount to a waiver of that obligation or right or any other obligation or right.
  • 6.5 You acknowledge that you have not entered into these terms and conditions in reliance on any statement or representation, except in so far as the representation has been incorporated into these terms and conditions. You irrevocably and unconditionally waive any right you may have to claim damages and/or to rescind these terms and conditions by reason of any misrepresentation (other than a fraudulent misrepresentation) not contained in these terms and conditions.
  • 6.6 These terms and conditions and your use of the Webpages are governed by English law and you agree to submit to the non-exclusive jurisdiction of the English court.
7 Notices

All notices shall be given by e-mail to us at mani@manickam.com, or to you at either the e-mail or postal address you provide to us. A notice will be deemed received 24 hours after an e-mail is sent or 3 days after the date of posting.
